ObamaCare Not “Law of The Land” ONLY House Can Tax!

ObamaCare.Cartoon_acaonthefritzObamaCare was not written as a tax. Only the House of Representatives in Congress can write a law that creates revenue through a tax, per Article 1 Section 7, of the US Constitution. ObamaCare was presented as a penalty. Thereby rendering it null and void.

We here at PushBackNow.comUSDefenseLeague.com have been effusively attempting to educate the American populace of the factual truth regarding the legality and Constitutionality of: ObamaCare aka The Affordable Care Act. It is NOT in any way, shape or form the “Law of The Land!”


Because ONLY The US House of Congress can initiate a law, a tax law, a bill or a resolution that demands money from the American People. The bill or law cannot be re-written from a penalty to a tax, created after the fact in SCOTUS, in the midst of a Constitutional review in the highest court of the land:  The United States Supreme Court. As powerful of a court as they are, they cannot create, initiate, birth, write, draft, re-write, implement or mandate ANY laws, bills, taxes, resolutions or Constitutional Amendments period. They can ONLY review the Constitutionality of a case before them!

Again, ObamaCare was not written as a tax. Only the House of Representatives in Congress can write a law that creates revenue through a tax. ObamaCare was presented as a penalty, thereby rendering all Executive Branch, Legislative Branch and Judicial Branch offspring, clones, twins and any variations pertaining to ObamaCare aka ACA (Affordable Care Act) null and void. And Here’s proof… One last thing, after you read it, share it, teach it and preach it. This is Truth, and Truth always prevails.

Article 1. Section. 7.

All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States: If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively. If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law.

Every Order, Resolution, or Vote to which the Concurrence of the Senate and House of Representatives may be necessary (except on a question of Adjournment) shall be presented to the President of the United States; and before the Same shall take Effect, shall be approved by him, or being disapproved by him, shall be repassed by two thirds of the Senate and House of Representatives, according to the Rules and Limitations prescribed in the Case of a Bill.

This should be the end of the conversation, but alas the proponents of the anti-ethical and burdensome ObamaCare Socialist One Payer Anti-American dream repeat their false mantra that it is the “law of the land” so deal with it. It is not. You deal with that! Liberals and radical Democrats and, unfortunately even some RINOs, have similar dreams for illegals to be supported by the ‘one-percenters’ and middle-income Americans amidst this great Republic of The United States of America. The Affordable Care Act’s weight will be shouldered by the healthiest and hardest working and doled out indiscriminately. The method of administering ObamaCare via its ‘Marketplace’ is another discussion entirely. And the means, using the IRS The Internal Revenue Service to regulate after such partisan assaults would be laughable if it weren’t so dangerous! The facts are facts and ObamaCare/Affordable Care Act is a reprehensible illegal mandate pushed onto the American people via unauthorized, illegitimate and UN-Constitutional means. It is therefore NULL and VOID. Take that Mr. President, Democratic Congress, RINOs, et al, or, submit yourselves unto the legislative mulch you created and languish thusly by applying ObamaCare to yourselves at once! Obama’s Priorities: Glitz and Glamour vs Security of Our Nation

OGitzNewly appointed Secretary of State John Kerry went under the radar to meet with the Saudi Crown Prince Salman bin Abdul Aziz, in Riyadh, Saudi Arabia today March 4th, 2013, and in addition, met with the president of the Palestinians, Mahmud Abbas, who arrived in Riyadh unannounced. Let’s remember that March 16, 2011—the day after the first mass demonstration against the Assad regime—John Kerry said Assad was a man of his word who had been “very generous with me” and “Syria will move; Syria will change as it embraces a legitimate relationship with the United States.” Now Syria threatens Israel and are encouraging US involvement in that threat.

It appears, at least by perusing events scheduled on the US Presidential Calendar, that Obama’s priorities are more to rub elbows with Hollywood’s elite such as 1600 Penn co-screenwriters who were both former and soon-to-be former Obama speechwriters.  The POTUS had invited the team and the actors of the 1600 Penn show to the White House this past January 9th, 2013. Notably absent on recent White House invitee lists are leaders of our nation’s allies, such as Britain’s Queen Elizabeth and Israel’s Benjamin Netanyahu, who might choose to discuss more substantial and relevant topics such as how to combat the Global War on Terror. Perhaps popcorn trumps politics, as does the government of Islam versus our US Constitutional guaranteed Freedoms. The POTUS is too busy currying special favors from the 6th Islamic Saudi King and cozying up to the President of the Palestinians to worry about problems on the US front apparently.  Some trivial topics may include the memory of Beyonce singing The National Anthem at Obama’s second Presidential Inauguration only to find out later that Beyonce’s performance was a “canned” pre-recorded version.  Even our United States Marines weren’t allowed to perform live for the event and were forced to “fake it” by pantomiming performing on their instruments during the playing of the recording of our United States National Anthem.


Citizens of the Republic of The United States, we might want to pay attention to Obama’s prioritized guest lists, functions and delegations abroad and at home.
Abdullah bin Abdulaziz Al Saud King of Saudi Arabia, was listed first on Obama’s Presidential Delegation being sent on behalf of the United States of America to the Inauguration of the first female President of South Korea.  The sixty-one year old President Park Geun-hye, was inaugurated as the very first female president to the Republic of Korea on February 25th, 2013. Obama and Geun-hye seem to employ the same musical taste and artists at the Republic of Korea’s Presidential Inaugurationand Obama’s Annual Holiday Event,  December 10th, 2012, with South Korean artist Psy.  Obama also sent many others to South Korea.  Notable attendees were VP Joe Biden and former Secretary of State Hilary Rodham Clinton. Obama Mandates Brainwashing US Workers with Compulsory ‘Cultural Sensitivity Training’ [Full Video]

http://i2.wp.com/thumbnails.illustrationsource.com/huge.2.14363.JPG?resize=450%2C318(Washington, DC) – Judicial Watch released previously unseen USDA videos revealing a compulsory “Cultural Sensitivity Training” program requiring USDA employees to bang on tables, chanting in unison “The pilgrims were illegal aliens” while being instructed to no longer use the word “minorities,” but to replace it with “emerging majorities.” Judicial Watch received the videos pursuant to a May 18, 2012, Freedom of Information Act (FOIA) request.

The sensitivity training sessions, described as “a huge expense” by diversity awareness trainer and self-described “citizen of the world” Samuel Betances, were held on USDA premises. The diversity event is apparently part of what USDA Secretary Tom Vilsack described in a memo sent to all agency employees as a “new era of Civil Rights” and “a broader effort towards cultural transformation at USDA.”  In 2011 and 2012, the USDA paid Betances and his firm nearly $200,000 for their part in the “cultural transformation” program.

USDA Training Administrator, Vincent Loran, in an October 10, 2011, email previously revealed by Judicial Watch, asked Betances for a copy of a training video vowing to keep it secret. “It will not be used for or show [sic] in any way shape or form,” Loran promised.  Nevertheless, Judicial Watch was able to obtain the video.  Highlights from the video of the taxpayer-financed diversity training include:

  • USDA Sensitivity Training Video Excerpt 1 – “If you take a look at all of you here and you think about your salaries and your benefits and what you have left undone – plus my fee – plus the expense of the team that putting the video together, this is a huge expense.”

  • USDA Sensitivity Training Video Excerpt 2 – “I want you to say that American was founded by outsiders – say that – who are today’s insiders, who are very nervous about today’s outsiders. I want you to say, ‘The pilgrims were illegal aliens.’ Say, ‘The pilgrims never gave their passports to the Indians.’” Betances also asked the audience, “Give me a bam,” after these statements, to which the audience replied in unison.

  • USDA Sensitivity Training Video Excerpt 3 – By the way, I don’t like the word ‘minorities.’ How about ‘emerging majorities?’”

“This USDA diversity training video depicts out-of-control political correctness,” said Tom Fitton, president of Judicial Watch. “Can someone please explain how any of this helps USDA employees to better serve the American taxpayer? This video further confirms that politically-correct diversity training programs are both offensive and a waste of taxpayer money.  No wonder it took over half a year to obtain this video from the Obama administration.”

As reported by Fox News in October, 2012, Judicial Watch first broke the news of the USDA compulsory sensitivity training program based upon information it obtained in response to a FOIA request. That request was prompted by a tip provided to the organization by a USDA whistleblower.

Judicial Watch also previously uncovered information revealing that in April 2011, the USDA had treated 300 of its employees to a taxpayer-funded ‘tasty celebration’ of dishes from around the world, salsa dancing lessons from Vincent Loran, and a rap performance by a USDA employee who shared his feelings on human differences.

White House Press Corps Outraged at Being Shut Out of Obama’s Entire Weekend

The White House press corps has been almost entirely shut out of President Obama’s weekend in Florida, and the journalists who make a living recording the president’s every move aren’t happy about it.

The Washington Post relates (all subsequent emphasis added):

[Obama] disappeared late Friday evening behind the gates of the Floridian, a lush golf and residential compound off limits to the public. Neither the public outside those gates, nor the media, has seen him since.

A photo of Obama on the course with someone as famous as Woods is commonly a moment the “traveling pool” of about a dozen journalists is allowed to witness. White House officials declined to allow that Sunday.

For the long weekend, the pool has been permitted just inside the Floridian gates, where reporters have used as their “filing center” a mirror-ceilinged party bus, the kind used for shouldn’t-be-driving evenings of bacchanalia like bachelor parties.

Because the president’s motorcade has not left the compound, White House officials have explained, there is no reason for the pool to track the president’s activities or to know who he is spending time with on a personal vacation.

White House Correspondents Association’s president Ed Henry released a statement condemning the lack of transparency Sunday:

“Speaking on behalf of the White House Correspondents Association, I can say a broad cross section of our members from print, radio, online and TV have today expressed extreme frustration to me about having absolutely no access to the President of the United States this entire weekend.  There is a very simple but important principle we will continue to fight for today and in the days ahead: transparency.”

But White House Principal Deputy Press Secretary Josh Earnest maintains:

“The press access granted by the White House today is entirely consistent with the press access offered for previous presidential golf outings. It’s also consistent with the press access promised to the White House Press Corps prior to arrival in Florida on Friday evening.”

Impeaching Obama Gains Steam


Let the president be duly warned. Rep. Walter B. Jones Jr., R-N.C., has introduced a resolution declaring that should the president use offensive military force without authorization of an act of Congress, “it is the sense of Congress” that such an act would be “an impeachable high crime and misdemeanor.”


Specifically, Article I, Section 8, of the Constitution reserves for Congress alone the power to declare war, a restriction that has been sorely tested in recent years, including Obama’s authorization of military force in Libya.

In an exclusive WND column, former U.S. Rep. Tom Tancredo claims that Jones introduced his House Concurrent Resolution 107 in response to startling recent comments from Secretary of Defense Leon Panetta.

“This week it was Secretary of Defense Panetta’s declaration before the Senate Armed Services Committee that he and President Obama look not to the Congress for authorization to bomb Syria but to NATO and the United Nations,” Tancredo writes. “This led to Rep. Walter Jones, R-N.C., introducing an official resolution calling for impeachment should Obama take offensive action based on Panetta’s policy statement, because it would violate the Constitution.”

In response to questions from Sen. Jeff Sessions, R-Ala., over who determines the proper and legal use of the U.S. military, Panetta said, “Our goal would be to seek international permission and we would … come to the Congress and inform you and determine how best to approach this, whether or not we would want to get permission from the Congress – I think those are issues we would have to discuss as we decide what to do here.”“Well, I’m almost breathless about that,” Sessions responded, “because what I heard you say is, ‘We’re going to seek international approval, and then we’ll come and tell the Congress what we might do, and we might seek congressional approval.’ And I just want to say to you that’s a big [deal].”

Asked again what was the legal basis for U.S. military force, Panetta suggested a NATO coalition or U.N. resolution.

Sessions was dumbfounded by the answer.

“Well, I’m all for having international support, but I’m really baffled by the idea that somehow an international assembly provides a legal basis for the United States military to be deployed in combat,” Sessions said. “They can provide no legal authority. The only legal authority that’s required to deploy the United States military is of the Congress and the president and the law and the Constitution.”

The filthy fly, usually found near decaying flesh emitting Putrescine and Cadaverine or frequently landing on defecates chose the chase our own POTUS today as he made two stinking appointments. It isn’t fly weather in D.C., but they have ‘visited’ him before. Where did this fly come from, and why? Seems far more frequent and more unnatural than not.

Flie have a long history of being associated to evil and death.  The fly as a symbol of impurity and temptation, to diverge from the path of righteousness. Flies are well-known carriers of viruses and represent corruption and putridness. And of course the fly is linked with maggots and to the Ten Plagues.

UPDATE: Obama shuts Keystone XL down. Nebraska Governor Circumvents Obama’s Federal Anti Keystone Pipeline Plan.

WASHINGTON (Reuters) – The Obama administration has delayed a decision on TransCanada Corp’s rerouted Keystone XL oil pipeline until after March, even though Nebraska’s governor on Tuesday approved a plan for part of the line running through his state.

“We don’t anticipate being able to conclude our own review before the end of the first quarter of this year,” said Victoria Nuland, a spokeswoman at the State Department, which had previously said it would make a decision by that deadline. Full post

God Bless Nebraska Gov. Dave Heineman! TransCanada just got final approval to build its pipeline from the tar sands of Alberta all the way to the Gulf Coast of Texas. Done.

Obama rejected the broader [Keystone XL] plan, saying the pipeline needed to be rerouted around Nebraska’s sensitive Sand Hills region. For that project, TransCanada needs presidential approval because it crosses an international border. The shorter portion only requires permits from state and federal agencies. TransCanada said the final of three permits it needed from the Army Corps of Engineers had been approved. The line from Cushing will help relieve a bottleneck at the Oklahoma refinery.

The governor approved a revised route for the Canada-to-Texas pipeline which his office said would avoid environmentally sensitive areas.

“Construction and operation of the proposed Keystone XL Pipeline, with the mitigation and commitments from Keystone would have minimal environmental impacts in Nebraska,” he wrote in a letter to Obama and Clinton.

The decision on final approval now rests with the Obama administration. The State Department is expected to decide within the next few months whether to permit the project to go forward — Heineman’s approval puts Obama in a difficult political spot.

The president had previously cited the Nebraska’s concerns about the pipeline as a key obstacle to approving the pipeline. At the same time, the president was able assuage the concerns of major environmental groups who not only voiced concern about the potential impact of a spill but also the emissions created by extracting and refining oil from what are known as oil sands in Canada.

After Obama in his inaugural address pledged to take action on climate change, the Sierra Club said it was “heartened” by Obama’s remarks and again urged the administration to reject “the dangerous tar sands pipeline.”

But supporters — including some in the president’s own party — have downplayed the environment impact and stressed the economic benefits the pipeline could bring. The pipeline is backed by the unions, and has been heavily promoted by Canadian officials. In Heineman’s letter, the governor said construction in Nebraska would yield $418 million in economic benefits.

Asked about the Nebraska governor’s decision Tuesday, White House Press Secretary Jay Carney noted the State Department was still reviewing the issue.

“There are stages in this process. … I don’t want to get ahead of that process,” Carney said.

There are other hurdles beyond the federal government’s approval — needed because the pipeline crosses the U.S.-Canada border. A state court case has challenged the law that gives Heineman the power to approve such plans.

The American Petroleum Institute hailed the Nebraska decision Tuesday as a major step.

“Another major hurdle has been cleared,” API Executive Vice President Marty Durbin said. “With the approval from Nebraska in hand, the president can be confident that the remaining environmental concerns have been addressed.”

The governor said the new route would avoid the sensitive Sand Hills region, though would “cross” a vital aquifer. The governor expressed confidence that enough protections were in place to allow the project to go forward.

Extreme Weather for Past Inaugurations

Most Dramatic and Tragic – 1841:  President William Henry Harrison was sworn into office on a cloudy, cold and blustery day. His speech lasted one hour and 40 minutes and he rode a  horse to and from the Capitol without a hat or overcoat. Pneumonia developed from a lingering cold he caught on that day and he died just one month later.Almost as bad – 1853: President Franklin Pierce was sworn into office on another cold and snowy day. He awoke to heavy snow in the morning which continued until about 11:30 am. Skies looked to be brightening by noon. Shortly after Pierce took his oath of office, as he began his inaugural address, snow started again. It came down heavier than ever dispersing much of the crowd and ruining plans for the parade. Abigail Fillmore, First Lady to the outgoing President Millard Fillmore, caught a cold as she sat on the cold, wet, exposed platform during the swearing-in ceremony. The cold developed into pneumonia and she died at the end of the month.

Worst Weather Day – 1909:  President William H. Taft’s ceremony was forced indoors due to a storm that dropped 10 inches of snow over the Capital city. The snow and winds began the day before. Strong winds toppled trees and telephone poles. Trains were stalled and city streets clogged. All activity was brought to a standstill. Sanitation workers shoveled sand and snow through  half the night. It took 6,000 men and 500 wagons to clear 58,000 tons of snow and slush from the parade route. See pictures. Despite the freezing temperatures, howling wind, snow, and sleet, a large crowd gathered in front of the Capitol to view the inauguration, but the weather forced the ceremony indoors. Just after the swearing-in, the snow tapered off.

Wash Out – 1937:  President Franklin Delano Roosevelt’s second inauguration. It was the first time the inauguration was held on January 20th. Two hundred thousand visitors came to Washington for the inauguration, though several thousand never got farther than Union Station. It was a cold rainy day. Some sleet and freezing rain was reported in the morning. Between 11 am and 1 pm, 0.69 inches of rain fell. The ceremony began at 12:23 pm. The noon temperature was 33°F. At the president’s insistence, he rode back to the White House in an open car with a half an inch of water on the floor. Later, he stood for an hour and a half in an exposed viewing stand watching the inaugural parade splash by in the deluge. Total rainfall for the day was a wet 1.77 inches and this amount remains as the record rainfall for January 20th.

Worst Traffic Jam – 1961: On the eve of the inauguration, 8 inches of snow fell and caused the most crippling traffic jam (for its time). Hundreds of cars were marooned and thousands of cars were abandoned.  The president-elect had to cancel dinner plans and, in a struggle to keep other commitments, is reported to have had only 4 hours of sleep. Former President Herbert Hoover was unable to fly into Washington National Airport due to the weather and he had to miss the swearing-in ceremony. By sunrise, the snow had ended and the skies were clearing, but the day remained bitter cold.  An army of men worked all night to clear Pennsylvania Avenue and despite the cold, a large crowd turned out for the swearing-in ceremony and inaugural parade. At noon, the temperature was only 22°F and the wind was blowing from the northwest at 19 mph making it feel like the temperature was 7°F above zero.

Unofficial: 1793 – George Washington; estimated 61°F in Philadelphia, PA.
Warmest Non-traditional Dates: August 9, 1974 – Gerald Ford; 89°F with partly cloudy skies and hazy conditions.

Coldest Inaugurations:

Coldest January Date (and overall):  1985 – Ronald Reagan’s second swearing-in ceremony on January 21 had to be held indoors and the parade was canceled. The outside temperature at noon was only 7°F. The morning low was 4° below zero and the daytime high was only 17°. Wind chill temperatures during the afternoon were in the -10 to -20°F range.
Coldest March Date:  1873 – Ulysses S. Grant’s second swearing-in ceremony. The morning low temperature of 4°F was a record for the month of March. The day remains the coldest March day on record. During the day, bitterly cold winds gusted up to 40 mph. By noon, the temperature had risen to 16°F. Wind chill temperatures were -15° to -30°F.  Cadets and midshipmen had been standing on the mall for more than an hour and a half without overcoats. Several of them collapsed. When the president delivered his inaugural address, the wind made his words inaudible to even those on the platform with him. The inaugural ball was held in a temporary building without heat. It had to be halted at midnight so people, who had been dancing in their overcoats and heavy wraps, could go home and get warm.

Hoover 48°F A heavy rain began just before the oath of office was administered, and the Capitol grounds and parade route were so crowded that it was impossible for anyone to run for cover. By the time he completed his inaugural address, President Hoover’s face was beaded with water and his suit was wringing wet. Herbert Hoover’s inaugural parade moved up Pennsylvania Avenue during a lull in the rain. (See picture below). Intermittent rain continued through the day. Total rainfall was 0.40 inches.
