FCC throws out The Fairness Doctrine, it’s about time.

President Obama and his administration, along with several Democratic lawmakers had discussed bringing it back into force, noting the popularity of conservative talk radio, which they argue falls into the public airwaves.

The Fairness Doctrine and 83 other “outdated and obsolete media-related rules” were tossed Monday into the regulatory dust bin of the Federal Communications Commission, in a move that the agency said helps it achieve the FCC’s “reform agenda.”

The Fairness Doctrine holds the potential to chill free speech and the free flow of ideas and was properly abandoned over two decades ago.

“Striking this from our books ensures there can be no mistake that what has long been a dead letter remains dead,” Genachowski said.

Finally the nails are in the Fairness Doctrine coffin…

The FCC also axed more than 80 media industry rules. Also consigned to the regulatory dustbin are the “broadcast flag” digital copy protection rule that was struck down by the courts and the cable programming service tier rate.

The Obama administration and the FCC have come under criticism by business groups over laws and regulations such as health care reform and net neutrality rules.

Conservatives have expressed concerns over the years that Democrats would try to revive the rules to kill conservative talk radio shows by requiring them to offer equal time to political opponents. Those concerns were heightened two years ago after the FCC appointed a vocal proponent of bringing back the Fairness Doctrine.
